E-Ligtas Binalbagan Citizen Terms & Protocol

Last Updated: September 2026 | Governing Authority: Municipality of Binalbagan LDRRMO

1. Nature and Scope of Service

E-Ligtas Binalbagan is an official digital emergency portal operated by the Local Disaster Risk Reduction and Management Office (LDRRMO). The system provides geographic hazard overlays (flood, landslide, lahar flow, and tsunami run-up), dynamic evacuation routing, weather radar tracking, and real-time shelter capacity monitoring. This platform serves as a supplementary operational tool and does not supersede direct physical orders, sirens, or localized directives issued by ground commanders, the PNP, BFP, or authorized barangay officials during an active state of calamity.

2. Data Privacy Act of 2012 (RA 10173) Compliance

We enforce the protection of your digital identity. By registering an account, you consent to the collection, processing, and temporary retention of specific personal data required strictly for municipal emergency response:

  • Data Collected: Full Name, Mobile Number, registered Barangay, family size, and active GPS coordinates during SOS or routing requests.
  • Purpose: Data is strictly utilized for dispatching rescue units, calculating the nearest open evacuation center, and preventing overcrowding beyond the strictly enforced 30-family (120 individual) limit per facility.
  • Data Isolation: Your personal data resides on secure municipal MySQL databases and is exclusively accessible by verified LDRRMO and MSWDO administrators. We do not sell, distribute, or utilize this data for commercial analytics.
3. Geolocation, API Usage, and Map Accuracy

E-Ligtas requires explicit browser or device permission to access your location to generate accurate routing polylines to primary, secondary, and tertiary evacuation centers:

  • Mapping APIs: Base maps and real-time weather layers are provided via third-party integrations (MapTiler, OpenStreetMap, RainViewer). The Municipality is not liable for upstream server outages from these providers.
  • GIS Overlays: The hazard shapefiles (.geojson) represent historical modeling and susceptibility projections. Actual disaster impact zones may vary based on unprecedented weather severity.
  • Dynamic Constraints: Estimated travel times are algorithmically penalized during active weather disturbances (e.g., a 20% speed reduction multiplier is applied during heavy rain). These remain estimates and do not account for real-time unmapped road blockages.
4. Prohibited Acts and False Reporting Penalties

The integrity of the E-Ligtas Citizen Reporting and SOS module is a matter of public safety. Engaging in the following activities will result in immediate permanent IP/Account bans and aggressive legal prosecution:

  • Submitting fabricated hazard reports, fake photo evidence, or false SOS dispatch requests.
  • Attempting to bypass the Admin Portal or inject malicious code into the database via the reporting modules.
  • Malicious false reporting during a declared state of calamity is punishable under the Revised Penal Code of the Philippines and relevant local municipal ordinances regarding public disruption.
5. Limitation of Liability and Force Majeure

Disaster environments are inherently unpredictable. You acknowledge that telecommunication networks, internet service providers, and power grids routinely experience outages during severe typhoons, earthquakes, and extreme weather.

Therefore, the Municipality of Binalbagan, the LDRRMO, the system developers, and the hosting providers shall NOT BE HELD LIABLE for:

  • Any physical injury, loss of life, or property damage resulting from reliance on the application's routing or hazard maps.
  • The inability to access the portal due to municipal power outages, shared hosting bandwidth limitations, or offline remote database servers.
  • Delays in SOS response times due to impassable terrain or depleted municipal rescue resources.

By continuing to use E-Ligtas Binalbagan, you acknowledge that you have read, understood, and agreed to these terms.
